1. Definitions
1.1. Oknow — a service for finding services, making bookings, and managing schedules, free slots and client databases. It includes Oknow Client for clients, Oknow Pro for specialists and salons, and web pages accessed through personal links. This Agreement applies to Oknow Pro and its related features.
1.2. Owner — an individual who is a citizen of the Republic of Kazakhstan, [Owner’s full name], who provides access to Oknow and holds the rights to the service. The Owner of Oknow and a business owner in Oknow Pro are different concepts.
1.3. Specialist — an Oknow Pro user who offers and provides services on their own behalf or on behalf of a business. A specialist may be an individual, an individual entrepreneur or a limited liability partnership. “You” refers to the person accepting this Agreement.
1.4. Business — a specialist’s or salon’s profile containing services, prices, schedules, employees and a client database. Business owner — a user with the owner role for that profile.
1.5. Employee — an Oknow Pro user who works within a business profile under their assigned role.
1.6. Client — a person who books a service, uses Oknow Client or is included in a specialist’s database. A client in the database may not have an Oknow account.
1.7. Client database — information about the clients of a particular specialist or salon: name, phone number, visit history with dates, services and amounts, selected communication channels, consents and opt-outs.
1.8. Slot — free time available for booking a service. A “flash slot” may be offered at a discount for a specific time during the offer period.
1.9. Campaign — sending offers from the specialist through Oknow Pro.
1.10. Consent — a client’s consent to offers from a particular specialist through selected channels, linked to the specialist and phone number. It is recorded separately from consent to Oknow marketing.
1.11. Personal link — a link associated with a particular client and action: a booking, consent, opt-out, selection of another time or a waitlist. A single-use consent link and a permanent opt-out link serve different purposes.
2. Scope of the Agreement and Acceptance
2.1. This Agreement is a public offer under Article 395 of the Civil Code of the Republic of Kazakhstan. It sets out the terms for using Oknow Pro.
2.2. The Owner grants you a non-exclusive right to use the available Oknow Pro features: managing a profile, services, schedules, slots, a client database and campaigns.
2.3. You accept the offer by registering a business and clicking “Continue”. By doing so, you accept this Agreement and consent to the processing of account and booking data under Section 5.
2.4. The service is intended for persons aged 18 or over (to be checked by a lawyer). An individual with legal capacity, an individual entrepreneur or a limited liability partnership acting through an authorised representative may accept the offer. If you accept on behalf of a business, you confirm your authority to act on its behalf.
2.5. The service contract is between the client and the specialist. Oknow does not provide specialists’ services, accept payment for them or take part in settlements with clients.
3. Pilot, Plans and Limits
3.1. Until payments are enabled, all businesses receive the Smart plan free of charge: unlimited slots, 500 SMS per month and personal messages with no numerical limit under the plan.
3.2. SMS is the only plan allowance that can be used up. Once it is used up, you may send personal messages manually or wait until the next month. All offers are subject to the consent and messaging rules in Sections 6 and 7.
3.3. Paid plans are activated only after advance notice and your express consent, with no automatic charges.
3.4. Oknow’s booking commission is 0%. The client pays the specialist directly for the service.
3.5. Before a campaign is sent, Oknow Pro shows the recipients, excluded clients, reasons for exclusion and cost. Reasons for exclusion include no consent, an opt-out, the seven-day limit and the control group.
3.6. The control group is selected randomly using a technical hash. By default, it consists of about 15% of candidates. These clients do not receive the offer in that campaign. Inclusion in the group has no other consequences.
4. Account, Business and Employees
4.1. Sign-in uses Apple, Google or email with a single-use six-digit code valid for ten minutes. Passwords and SMS codes are not used for sign-in.
4.2. The phone number in the profile is not verified by a code. You must provide only your own number. A match with a number in a client database does not by itself verify ownership of the number.
4.3. You must maintain access to your selected sign-in method and must not share single-use codes with others.
4.4. Only the business owner can access clients’ full phone numbers and export the database and consent log. Employees see masked numbers. Phone numbers are also stored only in masked form in records and logs, for example +7 7 * 12 34.
4.5. Only the business owner sends personal messages from their own messaging app. Oknow prepares the text, and the business owner sends it from their own number.
4.6. You are responsible for employees’ actions. You must ensure that they follow the rules on access and on handling the database, consents and offers.
4.7. Database access and exports are recorded in the audit log. Exported information remains personal data. It must be used in accordance with consents and the laws of the Republic of Kazakhstan.
5. Client Database and Personal Data
5.1. The specialist or salon is the owner and operator of its client database. It is responsible for the lawful creation and use of that database.
5.2. Oknow processes the database on your instructions to maintain it, handle bookings and visits, select offer recipients, and record consents, messages sent and opt-outs.
5.3. These instructions cover the data in Clause 1.7 and the consent log. When consent is confirmed through a link, the log contains the date, time, text version, confirmation method, IP address and browser.
5.4. Oknow does not use your database for other specialists or its own marketing. It does not sell or transfer it to other specialists. Transfers of specific information to suppliers to operate the service are described in Clauses 5.9–5.11.
5.5. Oknow acts as the owner and operator of Client and Pro account data and platform data. Account and booking data are processed on the basis of performance of the contract with the user and consent given by clicking “Continue”. For bookings made through a personal link without an account, the grounds are consent on the booking page and fulfilment of the booking. Consent and audit logs are kept to meet the duty to prove consent and to protect rights. Marketing and offers are permitted only with consent.
5.6. Servers, databases and encrypted backups are located in the Republic of Kazakhstan. Clients’ phone numbers are encrypted in the databases.
5.7. The database can be imported from xlsx or csv files. The file retention period is specified in Section 12. Information from the file becomes part of the database and is not automatically deleted with the file. All imported clients receive the “No consent” status. Previously collected consents may be transferred under the rules in Section 6.
5.8. The database is visible only to your business, subject to access roles. Advertising trackers, third-party analytics, AI analysis of correspondence and the WhatsApp Business API are not used. Only cookies technically necessary for signing in to the web panel and selecting a language are used. There are no advertising or analytics cookies or pixels. You can disable cookies in your browser, but sign-in on web pages may stop working.
5.9. For SMS, the phone number and message text are transferred to a provider in Kazakhstan, [SMS provider name]. As of the pilot version date, no contract has yet been signed. When push notifications are enabled, Expo Push, Google FCM and Apple APNs in the United States are used. They receive the push token, notification text and language.
5.10. If Google or Apple sign-in is selected, the identifier, email address and name are transferred to these recipients in the United States at the first sign-in. With Apple, the email address may be a private relay address.
5.11. The email provider, [email provider name], in the United States receives the email address and email text for sign-in codes and service emails. With separate consent to Oknow marketing, it also receives them for marketing emails. The provider may be replaced with a provider in the Republic of Kazakhstan. Specialists send personal messages to clients themselves.
5.12. A client has the right to access and receive a copy of their data, correct or delete it, withdraw consent, object to a solely automated decision, and apply to the authorised personal data protection authority [name as of the version date] or a court.
5.13. A request is submitted through the available app features or to support@oknow.online. It must contain a name, contact details for a reply and a description of the requested action. An account holder’s identity is verified by a code sent to the account email address. For a number without an account, verification uses a personal link sent by SMS to that number or confirmation with the specialist during a visit.
5.14. A response is provided within 15 working days. Offers stop immediately after an opt-out. Processing based on withdrawn consent stops within 15 working days. An objection to a solely automated decision is reviewed within three working days.
5.15. When a client in a database submits a request, Oknow fulfils it as the processing party across all databases. In the event of deletion, specialists are notified that deletion has occurred without disclosure of the reasons. You must take the fulfilled request into account in further dealings with the client.
5.16. The “who's due” feature automatically assesses visit history. It does not create legal consequences for the client or replace consent to offers.
5.17. The Owner of Oknow is responsible for data processing. In the event of a data breach, the authorised authority and affected persons are notified within the statutory deadlines. Affected persons receive a notification in the app, by email or by SMS. Specialists are notified within one working day after discovery of an incident affecting their database.
5.18. Deletion of a business and client database, restoration and retention periods are governed by Section 12.
6. Client Consents
6.1. Adding a client to the database, a booking or visit history does not constitute consent to offers. Offers are not sent when the status is “No consent”.
6.2. The client gives consent themselves through the specialist’s personal single-use link, valid for 30 days. Nothing is preselected. The client selects the channels.
6.3. The link may be provided through a QR code during a visit, one personal service message without discounts, or SMS from Oknow. Providing the link does not constitute the client’s consent.
6.4. Consent is recorded separately for each channel: SMS from Oknow, personal messages from the specialist in WhatsApp or Telegram, and push notifications in Oknow Client if the client has the app.
6.5. Consent applies only to the specialist whose name or business name appears on the consent page and to the client’s number. Consent to another specialist does not authorise you to send offers.
6.6. Previously collected consent may be transferred only for rows containing the consent date and channel. You must specify the source: a paper document, contract or correspondence. You must confirm that you retain the evidence. A visit date does not count as a consent date.
6.7. At the request of Oknow or the authorised authority, you must provide evidence of consent within five working days.
6.8. The consent log contains records of consent being given, opt-outs and messages sent, including the date, channel and text version. Access to exports is governed by Clause 4.4.
6.9. Consent remains valid until withdrawn, but for no longer than 24 months without visits to that specialist. Offers then stop automatically.
6.10. The permanent “Stop offers” link allows the client to opt out of offers from that specialist. The same page allows the client to opt out of offers from all specialists. The scope of the opt-out is shown before it is applied.
6.11. Replying STOP to an SMS from Oknow stops offers from all Oknow specialists to that number. The client may also click “Withdraw” in their Oknow Client profile.
6.12. If you receive “stop” in a messaging app, you must record the opt-out in the client’s record. After an opt-out, new offers stop being generated immediately. Messages already sent are not recalled.
6.13. Consent after an opt-out can be renewed only through a new single-use link from that specialist to the same number. A permanent opt-out link, an action in the app or an email code does not restore consent.
6.14. Service notifications about a booking are sent on the basis of the booking, without marketing consent. These include confirmations, booking reminders one day and two hours before the visit, cancellations and rescheduling. They cannot be disabled, but the channel can be changed.
6.15. Oknow marketing is off by default. It is enabled through a separate express action by the user. It does not replace consents to specialists. Opting out of it does not cancel those consents.
7. Messaging and Spam Prohibition
7.1. Offers from the specialist may concern their free slots, flash slots, discounts on those slots and repeat services based on visit history. Third-party advertising is prohibited.
7.2. No more than one message from a single specialist is allowed in seven days. No more than three messages per week per number are allowed from all Oknow specialists combined. Quiet hours are 21:00–09:00 Astana time. These limits also apply to messages sent personally. Circumventing them is prohibited.
7.3. Each offer must contain the specialist’s name, a personal booking link and a permanent “Stop offers” link. You must not remove them from the prepared text when sending a message personally.
7.4. Offers are permitted only with valid consent for the selected channel under Section 6. Knowing the client does not replace consent.
7.5. Buying or uploading other parties’ databases is prohibited. Using one business’s database for offers from another specialist without the client’s relevant consent is prohibited.
7.6. Inflating the “old” price, claiming a false discount or impersonating another specialist or business is prohibited. The offer terms must match the service and the specific slot.
7.7. Before launching a campaign, you must check the recipients, reasons for exclusion, content and cost. Checks in the interface do not replace lawful grounds for using the database or evidence of consent.
7.8. Personal messages are sent on your behalf and from your number. You are responsible for their content, recipients and compliance with opt-outs. Oknow’s preparation of the text does not change this responsibility.
8. Profile Information and Service Provision
8.1. You must provide accurate information about services, prices, schedules and the address. You must update it when it changes.
8.2. You are the service provider. You are responsible to the client for providing the service and for its quality.
8.3. The price is fixed when a hold is placed on the selected slot. It is shown before booking. The hold lasts ten minutes.
8.4. A booking is confirmed immediately or submitted as a request for a first visit or manual confirmation by the specialist. Within one hour, you must confirm the request, offer another time or reject it. If there is no response, it closes automatically and the client is notified. A request does not reserve time.
8.5. A flash slot discount applies only to the specified time through the link or offer until it expires, and no later than 30 minutes before the start. The discount does not carry over if the booking is rescheduled. The price for the new time is shown before the action.
8.6. Free cancellation is available until the later of these two times: three hours before the visit or 30 minutes after booking. The exact time is shown to the client. Late cancellation is also available and is recorded in the history visible to the specialist. The current version has no penalties or advance payments.
9. Access Restrictions and Blocking
9.1. Oknow may suspend a campaign or account access for a breach of this Agreement. This includes messages without consent, ignored opt-outs, other parties’ databases, circumvention of limits, false discounts and impersonation.
9.2. Restrictions are also permitted for breaches of employee access rules or threats to personal data. They may apply to a campaign or account.
9.3. A notice stating the reason is sent in the app and by email when the restriction is imposed.
9.4. You may submit an objection with explanations and evidence to support@oknow.online within ten working days. Oknow reviews it within ten working days and restores access if the breach is not substantiated.
9.5. Immediate blocking is permitted in the event of widespread spam complaints or a threat to data, with notice under Clause 9.3.
10. Liability
10.1. During the pilot, Oknow Pro is provided “as is”. There are no guarantees of filling slots, obtaining bookings, earning income or achieving any other commercial result.
10.2. The specialist is responsible for services and disputes with clients under Clauses 2.5 and 8.2.
10.3. You are responsible for the lawfulness of the database, evidence of consent, message recipients and content, recording opt-outs and the accuracy of information under Sections 4–8.
10.4. You must compensate the Owner for losses arising from third-party claims caused by your fault in breaching this Agreement. This includes an unlawful database, missing consents and message content.
10.5. The liability of the Owner of Oknow is limited to [amount — for a lawyer to determine]. The application of this limit is governed by the laws of the Republic of Kazakhstan (to be checked by a lawyer).
11. Intellectual Property
11.1. The rights to Oknow belong to the Owner. Access to Oknow Pro does not transfer exclusive rights to the service.
11.2. You retain the rights to your content. You grant the Owner a non-exclusive licence to display it in the service to operate the profile, services, slots and offers.
11.3. The licence does not change the purpose of the client database or the restrictions on its use under Section 5.
12. Term, Termination and Deletion
12.1. This Agreement remains in effect indefinitely from acceptance. The business owner may delete the business at any time through settings, with confirmation by an email code, or by a request to support@oknow.online.
12.2. The business owner can export the database before deletion. The business can be restored within 30 days. After that, the business and client database are deleted, except for the consent and audit logs retained under Clauses 12.5 and 12.6.
12.3. Oknow may end the pilot by giving you 30 days’ notice in the app and by email. Database export remains available until deletion.
12.4. Account data is retained while the account is active. An employee account is deleted under the procedure for a Client account. Deletion is confirmed by an email code, and the user is signed out on all devices. Subscriptions, the waitlist and favourites are deleted immediately and permanently. Personal upcoming bookings are cancelled, and specialists are notified. Those bookings do not return if the account is restored. Within 30 days, the same sign-in method can be used to restore the profile, visit history and consents. After that, the account is permanently deleted. Business bookings remain with the business. In specialists’ databases, the deleted user’s visits are retained without a name or phone number to keep records of services provided. Users can download their data before deletion.
12.5. Import files are retained for seven days, sent message texts for 90 days, and the audit log for three years.
12.6. The consent log is retained for the full duration of consent and for three years after withdrawal to confirm that consent was obtained and ended.
12.7. Backups are created daily and retained for seven days. Deleted data is removed from them during rotation within seven days.
12.8. For clients with no visits for 24 months, there are plans to notify the specialist and anonymise the data after a further three months. Offers stop after 24 months without visits under Clause 6.9.
13. Changes to the Terms
13.1. Oknow gives notice of changes to this Agreement in the app and by email at least 14 days before they take effect. The notice specifies the new version and its effective date. Corrections that do not worsen the user’s position take effect on publication.
13.2. A separate notice is sent for material changes to data processing. A new version of the documents does not change consents to offers from specialists or Oknow marketing. A new version of the consent text requires new consent.
13.3. Paid plans are introduced under Clause 3.3. Notice of a change to this Agreement does not replace express consent to activate them.
13.4. If you disagree, you may delete your account before the changes take effect. Continued use after that date constitutes acceptance of the new version. Previous versions are retained and provided on request.
14. Governing Law and Disputes
14.1. This Agreement is governed by the law of the Republic of Kazakhstan.
14.2. Personal data processing is governed by the Law of the Republic of Kazakhstan No. 94-V of 21 May 2013 “On Personal Data and Their Protection”, as amended in 2026, and other laws of the Republic of Kazakhstan. The Civil Code of the Republic of Kazakhstan, the Digital Code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan “On Advertising” also apply.
14.3. The parties first attempt to resolve a dispute through negotiations. Communications to the Owner are sent to support@oknow.online. A response is provided within 15 working days.
14.4. If no agreement is reached, the dispute is referred to a court in accordance with the laws of the Republic of Kazakhstan.
